1. General Conditions

 

a. Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg.

b. E-commerce Platform: Our store is hosted on Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

c. Eligibility: By agreeing to these T&Cs, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 

2. Products and Service

 

a. Nature of Products: CR3ATOGA products are primarily 3D-printed and/or customized. Due to the nature of the production process, there may be slight variations in color, finish, texture, or dimensions from product to product and from the images displayed on the Site. These variations do not constitute a defect.

b. Customization and Personalization: If you request customization or personalization, you are responsible for providing accurate and appropriate specifications (e.g., spelling, sizing, colors). We reserve the right to refuse any customization request that is deemed inappropriate, illegal, or infringes on third-party intellectual property rights.

c. Pricing and Availability: All prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time.

 

3. Orders, Payment, and Billing

 

a. Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

b. Payment: All purchases are subject to payment processing handled by Wix's third-party payment providers. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

c. Taxes: The customer is responsible for any sales tax, VAT, duties, or other government charges that may be imposed on your purchase.

 

4. Shipping, Production, and Delivery

 

a. Production Time: For in-stock items, we aim to ship within 1-2 business days. For personalized or custom orders, a production time of 2 to 5 additional business days may apply, as detailed in our Shipping Policy.

b. Shipping Costs: Shipping costs are dynamically calculated based on order specifics. Free Standard Shipping is offered for orders over $30 EUR.

c. International Duties: For international orders, all customs duties, taxes, and import fees are the sole responsibility of the customer. CR3ATOGA is not responsible for any delays caused by customs clearance procedures.

d. Risk of Loss: The risk of loss and title for all products purchased passes to you upon our delivery to the carrier.

 

5. Returns and Exchanges (Refund Policy)

 

a. General Returns: We accept returns on non-personalized, non-customized products within 5 days of delivery. The item must be unused, in its original packaging, and in the same condition that you received it. The customer is responsible for return shipping costs.

b. Custom/Personalized Items: Due to the bespoke nature of personalized or custom items, these products cannot be returned or exchanged unless they arrive damaged or defective.

c. Damaged or Defective Items: If your order arrives damaged or defective, please contact us immediately at creatogastudio@gmail.com with photographic evidence. We will assess the issue and offer a replacement or a full refund.

 

6. Intellectual Property

 

a. Our Content: All content on this Site, including product designs, text, graphics, logos, images, and the compilation thereof, is the property of CR3ATOGA or its suppliers and is protected by copyright and intellectual property laws. You may not use our intellectual property without our express written permission.

b. Customer Customization: If you submit images, text, or designs for customization, you warrant that you have the legal right to use those materials and that they do not infringe upon any third party's rights. You grant CR3ATOGA a non-exclusive, royalty-free license to use, reproduce, and modify the submitted materials solely for the purpose of fulfilling your order.

 

7. Limitation of Liability

 

CR3ATOGA shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Site or any products procured using the Site. Our liability is limited to the purchase price of the product sold.
